What is Withholding Tax Reclaims?

A withholding tax reclaim recovers the dividend tax a country withheld above the fund's treaty rate, filed in that country's form before its statute date. Withholding Tax Reclaims gives each fund a tax passport with one stamp per country, and seven agents find every over-withheld dividend overnight, check the evidence, draft the form in the local language, re-derive every figure, track the statute date and the authority's letters, and match the refund. An analyst prepares, a fund tax manager signs, and the head of fund tax signs above $250,000.

The problem

Why a dividend withholding tax reclaim is so easy to miss

Most countries withhold dividend tax at their domestic rate even when the fund's tax treaty allows less: Germany takes 26.375%, Switzerland 35%, Denmark 27% and France 25%, where a US fund's treaty rate is 15%. The difference belongs to the fund's shareholders, but it comes back only if someone files a withholding tax reclaim in that country's form and language, with the custodian's tax vouchers, a residence certificate for the right entity and year (Form 6166 for a US fund), often a beneficial-ownership statement, before a statute date that differs by country.

Today the fund tax team works from each custodian's monthly reclaim report. Those reports cover only the assets the custodian holds and the standard claims it files, so relief at source that failed, pension-rate and EU-law claims, and shares held in another account fall to spreadsheets. Shares on loan over the record date earn a manufactured dividend that cannot be reclaimed. Letters from tax authorities arrive in German, Italian, Danish or Korean with short reply windows, and a claim found after its statute date is lost to the fund for good.

One withholding tax reclaim, from the overnight find to filed

Quillfield Capital runs 120 funds that earn dividends in 35 countries. On Monday, October 19, 2026, the Quillfield Global Equity Fund's Germany 2023 claim waits for a signature. Here is how it was found, proven and filed, screen by screen, in the working solution.

  1. 01Monday, 06:10 New York

The day opens on what needs her, and on what the agents did overnight

Elena Varga · Fund tax manager

Elena signs filings up to $250,000 for the US funds. Her screen shows $41.8M recoverable and not yet filed across 612 claims, $126.3M filed and awaiting refund, and $58.9M recovered in 2026. Beside her five items, the agents' overnight brief is a conversation: the Income Finder checked 2,846 dividend payments across 120 funds and proposes 41 new reclaims worth $1,268,940, and the Statute Watcher reports 37 claims worth $6.2M within 90 days of their statute date.

Income Finder: “Still waiting for your signature: Germany 2023 for the Global Equity Fund, EUR 212,400 that Custodian A’s report missed, found in Friday’s run.”

  2. 02The tax passport

One stamp per country, and a question about the German one

Elena Varga · Fund tax manager

The fund's tax passport shows 16 country stamps, each with the rate withheld, the treaty rate, the money recoverable, its status and the last day to claim it. Germany reads 26.375% withheld, 15% treaty, EUR 212,400 recoverable, last day Dec 31, 2027, ready to sign. Elena asks “Why 26.375%?” and the Income Finder answers with the country rule, the treaty article and the custodian's voucher, each one click from its source.

“Germany withholds 25% capital yield tax plus a 5.5% solidarity surcharge on that tax, so 26.375%. The US–Germany treaty caps tax on portfolio dividends at 15% for a US resident beneficial owner.”

  3. 03Friday's run

16 German dividends the custodian's report missed, with lent shares left out

Income Finder · then Daniel Osei, fund tax analyst

The Income Finder matched 16 dividends from German issuers, paid April 28 to September 21, 2023, to Custodian A's 16 tax vouchers: EUR 492,487.91 withheld on EUR 1,867,252.70 gross, EUR 212,400.00 recoverable. The shares sat in a lending sub-account that Custodian A's reclaim service does not cover. On two payments, 52,000 shares were on loan over the record date; their EUR 82,800 of manufactured payments are excluded, with the lending record cited. Daniel checked the exclusions and accepted the finding.

Nothing becomes a claim until a person accepts it.

  4. 04Evidence and form

The right certificate for the right year, and the German form beside English

    Evidence agent · Forms agent

The Evidence agent checked the 2023 IRS Form 6166 against the fund administrator's record: the legal name “Quillfield Global Equity Fund, a series of Quillfield Funds Trust”, the EIN, a period covering every payment date and the signature, plus the beneficial-ownership statement signed March 3, 2026. The Forms agent drafted the German withholding tax refund claim, the online application to the Federal Central Tax Office, in German beside English, with every field cited to its source. Any edit needs a reason, and the Checker runs again after it.

The Forms agent never submits, and never changes a figure the Checker disputes.

  5. 05Before anyone signs

A second agent re-derives every figure on its own

    Checker agent

The Checker agent works from the income records, the vouchers and the treaty table. It cannot see the Forms agent's reasoning or edit the draft. It read the 16 income records and 16 vouchers, applied the 15% treaty rate and the 52,000 lent shares, and compared line by line: 16 of 16 agree, EUR 0.00 difference. Elena runs it again live before she signs, and it agrees again.

    “Any difference blocks signing.”

  6. 0609:14 · signed and filed

Daniel prepared it, so Elena signs, within her limit

Elena Varga · Fund tax manager

The sign step shows who prepared the claim, the independent check and the limit: $230,454 at EUR/USD 1.0850 is below $250,000, so the head of fund tax is not needed. Elena attests that she reviewed the 16 lines, the evidence and the check. The claim is filed through the online portal with receipt BZSt-KE-2026-4471893; from the firm's 214 German refunds, the Tracker expects the money around July 2027.

A preparer never signs or approves their own work. The rule is enforced, and every attempt is logged.

  7. 07A letter in Italian

The authority's query read in Italian, and the reply drafted in Italian

    Tracker

The Agenzia delle Entrate's Pescara office asks for three documents within 30 days on the fund's Italy 2023 claim of EUR 41,330: a beneficial-owner declaration, a list of the 2023 dividends with the tax withheld on each, and the 2023 US residence certificate. The Tracker shows the letter in Italian beside English, finds all three documents on file, and drafts the reply in Italian with them attached. A manager approves it before it goes; reply by Nov 13, 2026.

  8. 0873 days left

Every statute date worked back, and escalated on a ladder

    Statute Watcher

Each claim's statute date comes from its country rule: four years after the year of payment for Germany, Dec 31 of the second year for France. The Statute Watcher escalates at 120 days to the analyst, at 90 to the fund tax manager and at 45 to the head of fund tax. France 2024 for the Global Equity Fund, EUR 96,870, waits only for a signature on Form 5000 page 2; it has been with Elena since Oct 2, and at 30 days, with the evidence still incomplete, the ladder proposes a protective claim.

“A claim found after its date is lost to the fund for good.”

  9. 09For the auditors

One evidence pack for the claim, the fund or the period

    Thomas Reed · Internal audit

Every action by people and agents is on an append-only audit trail, chained so no entry can be changed afterwards, and kept 10 years. For WT-DE-23-0418 the pack holds the claim with every line and its source, the residence certificate and ownership statement, the form as filed in German and English, the signature and reason codes, each agent step with its version and confidence, and the fingerprint chain.

Ask in plain words

Ask about any stamp, claim or letter, in plain words

Every passport stamp, claim and work list has the agents beside it. Ask why, or tell them what to draft; every answer points to its source, and anything that changes a claim comes back to a person.

Why 26.375%?

Germany withholds 25% capital yield tax plus a 5.5% solidarity surcharge on that tax, so 26.375%. The US–Germany treaty caps tax on portfolio dividends at 15% for a US resident beneficial owner. Custodian A could not apply relief at source in Germany, so the full rate was taken on every voucher. The 11.375-point difference is reclaimable.

Were any shares on loan?

Two payments had shares on loan over the record date: 12,000 Isarwerk Elektro and 40,000 Weserland Immobilien. On lent shares the fund received a manufactured payment from the borrower, with no German tax withheld from it, so I excluded EUR 82,800.00 of payments. Claiming them would have added EUR 9,418.50 that the fund is not owed.

Why didn’t the custodian file it?

The 16 payments sat in the lending sub-account QF-GE-0042-L, which Custodian A’s reclaim service does not cover. Its Germany 2023 claim covered the main account only and was refunded Mar 18, 2026. I can draft a note asking Custodian A to bring the sub-account into scope.

When will the refund arrive?

From this firm’s 214 German refunds since 2021, the median is 9 months from filing (middle half 7 to 13). If filed today, expect the refund around July 2027; I will watch for the acknowledgment within 3 weeks and chase at 6 months.

Questions

What fund tax teams ask about withholding tax reclaims.

How long do we have to file a withholding tax reclaim?

It depends on the country, and each counts differently. In the solution's country rules, Germany allows four years after the end of the year of payment, France until Dec 31 of the second year after payment, Switzerland three years after the end of the year, Italy 48 months after the payment date and Denmark five years after the dividend date. The Statute Watcher dates every claim from its versioned rule and escalates at 120, 90, 45 and 30 days.

Doesn't our custodian already file our tax reclaims?

A custodian's withholding tax reclaim service files standard claims for the assets it holds. The Income Finder works from your own portfolio accounting across every custodian, so foreign withholding tax recovery also covers relief at source that failed, pension and special rates, EU-law claims and accounts the custodian's service does not cover. Where a custodian already files a claim the finding says so, and one that duplicates a filed claim is recommended for dismissal.

What evidence does a dividend withholding tax refund need?

Usually the custodian's tax vouchers, a residence certificate for the right entity and year, such as IRS Form 6166 for a US fund (requested on Form 8802), often a beneficial-ownership statement, and sometimes a power of attorney. The Evidence agent checks each for entity name, tax ID, period, signature and stamp before a claim relies on it, and flags a certificate that names the SICAV instead of the sub-fund or has two digits of the tax ID swapped.

Are manufactured dividends on lent shares reclaimable?

No. On shares on loan over the record date the fund receives a manufactured payment from the borrower, with no tax withheld from it, so there is nothing to reclaim. The Income Finder reads the securities lending records at each record date and excludes those shares from the claim, citing the lending record.

What does the FASTER directive change for withholding tax reclaims?

FASTER is the EU withholding tax directive, Council Directive (EU) 2025/50, and it applies from Jan 1, 2030: a digital tax residence certificate, relief at source or a quick refund through certified intermediaries, and 10-year record keeping. Member states may keep dividends above EUR 100,000 per payment on the standard route, so large funds will still file standard reclaims. The recovery report shows each EU country's route from 2030 and where its transposition stands.

Do people stay in control of what is filed?

Yes. Nothing is filed until a fund tax manager signs it, and no reply goes to a tax authority until a manager approves it. The agents never sign, post or write off a refund, never change a country rule and never edit a certificate. An analyst accepts each finding, the head of fund tax signs above $250,000, and the preparer can never sign the same claim.

How long does it take to go live?

The Agentic Solution Engine builds and deploys it from your requirements and documents: your funds and entities, custodian files, country rules and signing limits. First-time setup connects the funds, systems, country rules and people and runs a four-year backfill scan for the starting inventory, and it goes live once every quality gate has passed.
